This lawsuit, filed in the Northern District of California, marks the second time Musk has taken legal action against Altman. Musk’s complaint alleges that Altman and Greg Brockman, the President of OpenAI, have deviated from the company’s founding agreement. The lawsuit claims that the duo prioritized profits over public interest, a move that Musk argues is a breach of contract. The crux of the dispute lies in OpenAI’s partnership with Microsoft. Musk asserts that this collaboration was a departure from OpenAI’s original mission of developing AI technology for the benefit of humanity. The lawsuit seeks to invalidate OpenAI’s exclusive license with Microsoft, which grants the tech giant unique access to the code of GPT-4. The lawsuit also alleges that Altman and Brockman deceived Musk into co-founding OpenAI back in 2015. Musk claims that he was promised the company would operate as a non-profit, focusing on safety and openness for the benefit of humanity, not shareholder value. Musk’s previous lawsuit against Altman and OpenAI was withdrawn two months ago. The reasons for the withdrawal were not publicly disclosed.
